ELD Compliance for Owner-Operators: HOS, Malfunctions, and DOT Audits
The Short Answer
Stay under 11 hours driving in a 14-hour on-duty window, take a 30-min break by hour 8, and reset with 10 consecutive off-duty hours. Log personal conveyance correctly. Fix ELD malfunctions within 8 days or paper-log until repaired.
ELD violations are the fastest way to a DOT audit and CSA points that make your insurance uninsurable. Here is what compliant actually looks like.
11 hours max driving in a 14-hour on-duty window, 30-minute break required by hour 8 of driving, 10 consecutive off-duty hours to reset. 70-hour rolling 8-day cap. 34-hour restart resets the 70-hour clock.
The 11/14/10/70 Rule Set
| Rule | Meaning |
|---|---|
| 11-hour driving | Max 11 hours behind the wheel per shift |
| 14-hour window | Total on-duty window from first work minute |
| 30-min break | Required by hour 8 of driving |
| 10-hour reset | 10 consecutive off-duty hours to start new shift |
| 70-hour rolling | 70 hours max on-duty in any rolling 8-day period |
| 34-hour restart | 34 consecutive off-duty resets the 70-hour clock |
Personal Conveyance: The Most Abused Rule
Personal conveyance is off-duty driving of a laden or empty commercial vehicle for personal reasons — going home from a truck stop, getting food, moving to safe parking. It is NOT: continuing your route toward the delivery, moving to a shipper, or extending your shift. DOT enforces this hard.
The 8-day malfunction rule
If your ELD malfunctions, you have 8 days to repair or replace it. During that time, paper-log manually. Document the malfunction (screenshot the error). Not fixing within 8 days is an OOS violation.
What DOT Looks at in a Compliance Review
- 6 months of ELD logs (accurate, no falsified entries)
- Driver qualification files (CDL, medical card, MVR)
- Drug/alcohol testing records (pre-employment + random)
- Vehicle maintenance records (inspections, repairs)
- IFTA records + fuel receipts
- Insurance certificates and BOC-3 on file
- Accident register
CSA Score: Why It Matters
CSA (Compliance, Safety, Accountability) tracks 7 BASIC categories including HOS compliance and unsafe driving. Alerts (score above threshold) trigger DOT reviews. High CSA scores make insurance more expensive and brokers reluctant to book you.
Common ELD Violations
- Driving after 11 hours
- Not taking 30-minute break
- Misusing personal conveyance
- Log editing without valid annotation
- Not carrying ELD user manual in cab
- Not having 8-day paper log supply
Frequently Asked Questions
What happens if my ELD breaks?+
Paper-log immediately, notify your carrier/self, and repair or replace within 8 days. Document the malfunction. This is legal short-term operation.
Can I use personal conveyance to extend my day?+
No — personal conveyance cannot advance your load, save your delivery window, or otherwise be part of a work purpose. It's for going home, food, or safe parking only.
How long does DOT keep my ELD records?+
You must keep 6 months of ELD data at all times. DOT can request during any audit or roadside inspection.
