
DQF, Clearinghouse queries, and drug program setup before driver #1
The Driver Qualification File contents required by 49 CFR 391, pre-employment vs annual Clearinghouse queries, and how to set up random pool + policy before you legally can dispatch a driver.
The three things you MUST have before a driver rolls a wheel
You cannot legally dispatch a hired driver until you have:
- 1A complete Driver Qualification File (DQF) for that driver
- 2Full Clearinghouse pre-employment query run and cleared
- 3The driver enrolled in your random drug/alcohol pool
Miss any of these and:
- The driver drives illegally
- You are 100% liable for any incident
- Your insurance can deny claims
- Automatic safety audit failure
The Driver Qualification File — the 10 documents
For each driver hired, per 49 CFR §391.51:
At hire
- 1Employment application — signed, using DOT-compliant form (includes 3-year employment history)
- 2CDL copy (both sides, current)
- 3Medical Examiner's Certificate (DOT medical card, current)
- 4Motor Vehicle Record (MVR) — pulled from state DMV within last 30 days
- 5Road test certificate OR CDL waiver (CDL substitutes for road test)
- 6PSP report (Pre-employment Screening Program from FMCSA)
- 7Previous employer safety history — you must reach out to their DOT employers from past 3 years and document responses (or lack thereof)
- 8Pre-employment drug test — negative result on file
- 9Clearinghouse pre-employment query — negative or cleared result on file
- 10Signed drug & alcohol policy acknowledgment
Annually
- 1Annual MVR (fresh pull every 12 months)
- 2Annual driving record review — you sign a memo reviewing their MVR
- 3Annual limited Clearinghouse query
- 4Renewed medical certificate every 24 months (or when it expires)
Ongoing
- Any accident report (DOT-recordable)
- Any violation (roadside inspection with driver-attributed violation)
Store in a secure, accessible file (physical binder OR cloud folder). Retain for 3 years after driver leaves.
Clearinghouse — the two-query system
Pre-employment query (before dispatch)
Full query = looks at every violation in the driver's Clearinghouse record.
Process:
- 1In your carrier account, request a full query on the driver's CDL number
- 2Driver receives email, logs into their driver account, grants consent
- 3Results in 24–72 hours (usually instant)
- 4Print/save result → into DQF
Cost: $1.25 per query. Buy a 5–10 query plan for efficiency.
Annual limited query
Limited query = "does this driver have any violations in Clearinghouse?" (yes/no, no details)
Process:
- 1Get driver's one-time consent on a form (signed) — this consent covers ALL future annual limited queries
- 2Run query on the driver's CDL once per calendar year
- 3If it says YES (violations exist), you must within 24 hours request a full query and get driver consent
- 4Save result → DQF
Drug & alcohol program — the 6 pieces for a fleet
Once you have a driver on payroll:
- 1Written policy — same policy from the solo O/O lesson, but now covers employees
- 2Consortium enrollment — most consortiums move you from "solo" to "small fleet" plan (~$200–$400/yr)
- 3Random pool — the consortium includes all your drivers in a pool. You'll get quarterly selection notifications
- 4Pre-employment testing — every driver, before their first mile
- 5Post-accident testing — required within 8 hours after any DOT-recordable crash where a driver receives a citation or someone is transported for medical care
- 6Reasonable suspicion — you need supervisor training to identify signs of impairment (many consortiums offer this online, 1 hr, $40)
What "hire" means legally
You "hire" a driver the moment any of these are true:
- You dispatch them on a load
- You have them drive your truck for compensation
- You put them on payroll or 1099
Independent contractor drivers don't get you off the hook. If they operate under YOUR MC, they are subject to YOUR DQF, YOUR drug program, YOUR insurance. Period. FMCSA does not care about your tax classification.
The exact hire workflow (do this in order)
Week -1 (before job offer)
- Pull PSP + MVR on candidate ($10 + $10)
- Contact 3-year DOT employer history
- Interview
Day of conditional job offer
- Send Clearinghouse full query
- Send driver to lab for pre-employment drug test
- Have them sign application, policy acknowledgment, annual query consent
Day of drug test negative + Clearinghouse clear
- Officially hire
- Add to consortium random pool
- Complete road test (if not CDL)
- Add to your insurance policy (call agent before dispatch)
First day on the truck
- Ride-along or supervised orientation trip
- Provide truck + policies + ELD credentials
- Log first day in DQF
Total elapsed time: 5–10 business days. Rushing this is how carriers get sued.
Insurance impact of hiring
- Adding any driver: call your agent — expect $200–$800/yr premium change per driver
- Adding a driver with imperfect MVR (any moving violation last 3 yrs): $1,500–$4,000/yr increase
- Adding a driver under 25: most standard carriers won't insure; specialty markets 2–3x rate
- Adding a driver with any drug violation in Clearinghouse: almost always uninsurable at any commercial carrier
Rule: get insurance quote BEFORE offering the job.
Common expensive mistakes
- 1Skipping the previous employer verification. If a driver had a positive drug test at prior employer and you didn't ask, you're liable.
- 2Not documenting the annual driving record review. Auditor asks "did you review Joe's MVR this year?" You say yes. They ask for the signed memo. You don't have it. Finding.
- 3Missing the annual Clearinghouse query. Same — automatic finding.
- 4Random pool selections ignored. If a driver refuses or you don't send them, they're disqualified from CMV work permanently.
- 5Owner-operator sub-contractors under YOUR MC without a DQF. Federal violation. Fix: put them on YOUR compliance program, OR they run under their own MC.
Homework
- Build a DQF template folder (10 docs above, blank templates in each)
- Buy a Clearinghouse query plan (10 queries $12.50)
- Talk to your consortium about small-fleet pricing
- Get supervisor training on reasonable suspicion
- Draft your written drug & alcohol policy
- Practice-run the hire workflow on yourself before your first hire
